Terms & Conditions

1. Scope

These Terms & Conditions (the “Terms”) govern the use of the PAIR platform and related services (“PAIR”, “Service”) provided by RIGHT-WAY.AI e.U. By creating an account, accessing or using PAIR, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.

2. Services

PAIR provides AI-supported tools for hiring automation, including but not limited to: creating job descriptions, collecting and analyzing candidate data, conducting AI-based screening calls and providing structured summaries and insights.

The specific scope of services, features and usage limits may vary depending on the subscription plan selected by the customer (e.g. number of users, credits, integrations).

3. Account Registration & Access

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must ensure that all account information is accurate and up to date.
  • You are responsible for all activities carried out under your account.
  • You must notify us immediately of any unauthorized access or suspected security incident.

4. Acceptable Use

When using PAIR, you agree NOT to:

  • Violate any applicable laws or third-party rights.
  • Upload or process content that is unlawful, discriminatory, hateful or harmful.
  • Attempt to gain unauthorized access to the Service or underlying infrastructure.
  • Reverse engineer, decompile or otherwise attempt to derive the source code of the Service.
  • Use PAIR to make automated decisions that unlawfully discriminate against individuals.

5. AI Output & Responsibility

PAIR uses AI technologies (including third-party AI APIs) to generate suggestions, summaries and recommendations. AI-generated output is probabilistic and may contain inaccuracies or omissions. The Service is designed as a decision-support tool only.

You remain solely responsible for:

  • Reviewing and validating any AI output before relying on it.
  • Ensuring that hiring decisions comply with labor, anti-discrimination and privacy laws.
  • Providing appropriate human oversight in all recruitment decisions.

6. Fees, Credits & Billing

Subscription fees, credit packages and overage rates are described on the PAIR pricing page or in your specific commercial agreement. Unless otherwise stated:

  • Fees are invoiced in advance for the selected billing period.
  • Credits represent a usage allowance (e.g. AI minutes, calls, analysis) and may expire as stated in your plan.
  • All fees are non-refundable unless required by mandatory law.

7. Data Protection & Privacy

The processing of personal data via PAIR is governed by our Privacy Policy and, where applicable, by a separate Data Processing Agreement (“DPA”) with business customers.

In case of conflict between these Terms and the DPA regarding personal data, the DPA prevails for the relevant processing activities.

8. Third-Party Services & Integrations

PAIR may integrate with third-party services (e.g. email providers, ATS/HR systems, AI APIs). Your use of such services may be subject to additional terms of the respective providers.

RIGHT-WAY.AI e.U. is not responsible for the availability, security or content of third-party services.

9. Intellectual Property

All intellectual property rights in PAIR, including software, design, logos and content (excluding customer content) remain with RIGHT-WAY.AI e.U. or its licensors.

You receive a non-exclusive, non-transferable, limited right to use the Service during the term of your subscription, solely for your internal business purposes.

10. Term & Termination

  • The agreement begins when you create an account or sign a commercial order.
  • It continues for the chosen subscription term and renews as agreed (e.g. monthly/annually).
  • Either party may terminate for cause if the other party materially breaches these Terms and fails to cure within a reasonable period.
  • Upon termination, your access to PAIR may be disabled and data may be deleted according to our retention policies and the DPA.

11. Disclaimer & Limitation of Liability

To the extent permitted by law, the Service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation.

RIGHT-WAY.AI e.U. is not liable for any indirect, incidental, consequential or punitive damages (including loss of profit, loss of data or business interruption), except in cases of intent or gross negligence or where mandatory law provides otherwise.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Austria, excluding its conflict of law rules. The competent courts of Vienna, Austria, shall have exclusive jurisdiction, unless mandatory consumer protection rules specify otherwise.

13. Changes to These Terms

We may update these Terms from time to time, for example when we introduce new features or due to legal changes. The current version is always available on this page. Material changes will be communicated in an appropriate manner.
